Terms of Use.

Acceptance of terms.

By using PlanetHello, you acknowledge that you have read and agree to be bound by these Terms of Service, this User Agreement, and our Privacy Policy. If you do not agree with these terms, you must not use the app.

By installing the PlanetHello app through the Apple App Store, you also agree to the End User License Agreement terms below.

Eligibility.

PlanetHello is intended for adults. Users must be 18 years of age or older to use the platform. Users must report anyone they believe is under 18.

Some app store license language may reference a lower minimum age or parental consent. PlanetHello's service rule is adults only; where rules differ, the stricter age requirement applies.

Anonymous audio calls.

PlanetHello allows users to connect anonymously for audio calls only. No posts or files are shared through the app.

You agree not to disclose personal information to other users, including your full name, address, phone number, email address, physical location, workplace, school, or other identifying information.

Safety promises.

To keep PlanetHello safe and appropriate, users agree to the following rules and agree to report violations through the app's reporting tools.

• Confidentiality. You will never reveal your physical location and will report anyone who does.
• Privacy. You will never reveal your name or personally identifiable information and will report anyone who does.
• Solicitation. You will not solicit money, gifts, donations, financial information, or payment for services.
• Recording. You will not record, capture, transcribe, or otherwise preserve any call.
• Respect. You will treat other users with class, courtesy, and respect.
• Harassment. You will not harass, threaten, demean, hate, or discriminate based on race, ethnicity, gender, sexual orientation, religion, disability, or any other personal characteristic.
• Illegal activities. You will not use PlanetHello for illegal activities, illegal content, or criminal behavior.
• Impersonation. You will not impersonate another user, public figure, or any other person.
• Commercial use. You will not use PlanetHello to advertise, promote, or sell products or services.
• Harmful activities. You will not harm the platform or other users, including by hacking, spreading malware, or attempting to disrupt the service.

Prohibited conduct.

You agree not to use PlanetHello for any unlawful or prohibited purpose. This includes harassing, threatening, or defaming other users; transmitting obscene, offensive, or objectionable content; violating intellectual property rights; or attempting to hack, reverse engineer, or access the app's source code.

Content or behavior may not be submitted to, shared through, or used on PlanetHello if it includes objectionable content. PlanetHello may moderate content and behavior and decide whether a submission, account, or activity violates these terms.

• Sexually explicit material.
• Obscene, defamatory, libelous, slanderous, violent, unlawful, abusive, or profane content.
• Content that infringes the rights of any third party, including copyright, trademark, privacy, publicity, or other personal or proprietary rights.
• Deceptive or fraudulent content or behavior.
• Content that promotes the use or sale of illegal or regulated substances, tobacco products, ammunition, or firearms.
• Gambling, including online casinos, sports books, bingo, poker, or related activity.

Reporting and enforcement.

Users who witness violations should report them immediately using the reporting mechanism provided in the app. PlanetHello may review reports and take action when we believe these terms, our Community Guidelines, or our safety rules have been violated.

Users who violate these terms may have their account suspended or terminated, and access to the platform may be restricted. Enforcement may include warnings, temporary suspensions, verification requirements, or permanent bans.

Apple App Store license.

This End User License Agreement is between you and PlanetHello and governs use of the PlanetHello app made available through the Apple App Store.

This agreement is between you and PlanetHello only, not Apple Inc. You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this agreement and that Apple has the right to enforce this agreement against you. PlanetHello, not Apple, is solely responsible for the PlanetHello app and its content.

Limited license.

PlanetHello grants you a limited, non-exclusive, non-transferable, revocable license to use the PlanetHello app for personal, non-commercial purposes.

If you use PlanetHello on an Apple device, you may only use the app on Apple devices that you own or control and as permitted by the App Store Terms of Service.

Privacy under the license.

PlanetHello may collect and use information about your usage of the PlanetHello app, including certain types of information from and about your device. PlanetHello may use this information, as long as it is in a form that does not personally identify you, to measure use and performance of the app.

Maintenance and support.

PlanetHello may provide minimal maintenance or support for the app. To the extent maintenance or support is required by applicable law, PlanetHello, not Apple, is responsible for providing it.

Warranty disclaimer.

PlanetHello is provided "as is" without warranties or representations, express or implied. We do not warrant that the app will be uninterrupted or error-free, nor do we make representations regarding use or results of the app.

PlanetHello disclaims all warranties about the PlanetHello app to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, PlanetHello, not Apple, is solely responsible for that warranty.

Limitation of liability.

To the fullest extent permitted by law, PlanetHello shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the app.

Indemnification.

You agree to indemnify and hold PlanetHello harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the app, your violation of these terms, or your violation of any rights of another user or third party.

Product claims.

PlanetHello, not Apple, is responsible for addressing claims relating to the PlanetHello app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar laws.

Nothing in these terms is an admission that you may have such claims.

Third-party intellectual property claims.

PlanetHello is not obligated to indemnify or defend you with respect to any third-party claim arising out of or relating to the PlanetHello app, except to the extent required by applicable law.

To the extent PlanetHello is required to provide indemnification by applicable law, PlanetHello, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any claim that the PlanetHello app or your use of it infringes a third-party intellectual property right.

Changes to these terms.

These terms may change at any time. Users are responsible for keeping up to date with updates or changes. Your continued use of the app after modifications means you accept the modified terms.

Governing law.

These terms are governed by the laws applicable to PlanetHello. The source legal text identifies courts located in New York, NY, United States for legal actions arising out of or relating to the User Agreement.
